Life estates in Texas work through creating a joint ownership interest in a property. The ownership interest is created by filing a notarized life estate deed.


You hold the right to use and occupy the property for your lifetime, after which CAP takes possession of the property.


A life estate can include both a home and property.

Did you know?

Life Estate donors can receive ​an immediate charitable ​income tax deduction for a ​portion of the property's ​appraised value in the year of ​the gift.


For federal income tax ​purposes, donors can deduct ​up to 30% of their adjusted ​gross income, and any unused ​deductions can be carried over ​for up to five years. Donors can ​also avoid capital gains tax on ​the appreciated value of the ​property.

One of the most straightforward ​ways to make a charitable donation ​to CAP after death is via a bequest ​through your will.


A bequest is a gift of money, ​property, or assets that is ​designated in your will or trust.


You can choose to leave a specific ​dollar amount, a percentage of your ​estate, or a specific asset.


The proper wording to include is, “I ​give, devise and bequeath to ​Citizens for Animal Protection, Inc. ​the sum of _____ or _____ % of the ​residue of my estate in support of ​its general purposes.”

Anyone can make a bequest—in any amount—to an individual or charity. Bequests can be simple or complex, with conditions about how the gifts can be used.

When you name Citizens for Animal Protection as a beneficiary to receive your IRA or other retirement assets upon your death, the full amount of your retirement account will directly benefit CAP and the animals.


Making us the beneficiary of your IRA or other retirement assets is typically straightforward: Fill out a designated beneficiary form through your employer or your plan administrator.

People who are age 70 ½ or older can contribute up to $100,000 from their IRA directly to a charity and avoid paying income taxes on the distribution. This is known as a qualified charitable distribution.

By creating and contributing to a ​donor advised fund, you can take an ​immediate tax deduction while ​retaining the ability to make grants to ​CAP over time, as well as designate ​the entirety or a portion of the fund to ​be distributed to CAP upon your ​passing.
